HHS has conducted ZERO oversight of Planned Parenthood since 2007 -- the story next on FOT

The NIH Revitalization Act of 1993 states that the U.S. Department of Health and Human Services (HHS) should be auditing Planned Parenthood, as Planned Parenthood is involved in research on aborted fetuses and HHS is supports this work with funding. The Stream filed its FOIA request with HHS in July, asking for documents and emails related to Planned Parenthood and the audits. The initial response on August 24, the deadline, was that they had no documents fitting the description of the public records that The Stream had requested.

Continuing to press for information, The Stream has received redacted emails and several letters from HHS to Congress stating that “The NIH [HHS] did not provide any financial support for human fetal tissue transplantation research [after 2007].” The question posed by Ms. Alexander is: “If this is accurate, what about all the harvesting of fetal body parts that Planned Parenthood itself categorizes as research? HHS provides Planned Parenthood with the majority of its federal funding, and has continued to do so up to the present.”

Additionally, most of the emails HHS sent to The Stream were heavily redacted, without explanation. In response to the redactions, Steve Aden, Senior Counsel for Alliance Defending Freedom, notes: “The FOIA Statute wasn’t intended to empower the government to stonewall the public,” he responded. “Using FOIA as a shield to keep its own deliberations on how to ‘spin’ its decisions to the public secret is a flagrant violation to the letter and spirit of the law.”

In addition, Rachel has been reporting on the case of a high school football coach, Joe Kennedy, who is being threatened with dismissal if he continues to lead prayers after games. She currently writes for numerous e-zines on the web, including The Stream, and the International Oracle Syndicate. Employed as a Deputy County Attorney with the Maricopa County Attorney’s Office in Phoenix, Arizona, Rachel is a former Assistant Attorney General for the State of Arizona, where she practiced Commercial and Administrative Law and a former cyberlaw attorney for GoDaddy, a software corporation in Scottsdale, Arizona. She also does pro bono work referred to her by the Alliance Defending Freedom, a religious constitutional rights organization in Scottsdale, Arizona.

Congress will get unedited Planned Parenthood videos

Court Rules that Congress Can Receive Full Unedited Footage of Undercover Investigation into National Abortion Federation and Planned Parenthood

Potential Constitutional Clash between Federal Court and Congress Averted

(October 6, 2015 - SAN FRANCISCO) – This afternoon, in response to arguments by the Thomas More Society, counsel for David Daleiden, U.S. District Judge William H. Orrick III has ruled that David Daleiden and The Center for Medical Progress may respond to Congress’s subpoena seeking all unedited video footage of Daleiden’s undercover investigation into trafficking in fetal body parts by Planned Parenthood and other National Abortion Federation affiliates. 

“The National Abortion Federation has gone to extraordinary lengths to keep David Daleiden’s footage of its annual meetings out of the hands of law enforcement and the Congress,” said Peter Breen, Thomas More Society Special Counsel. “We’re pleased that the District Court has today decided to allow Congress to seek the unedited footage of the wrongdoing uncovered by David’s investigation. We will continue to urge the District Court to allow David to release more undercover videos featuring the footage from these annual meetings to the public, so that the American people can make their own assessment of the practices of Planned Parenthood and the National Abortion Federation.” 
The National Abortion Federation had urged Judge Orrick to forbid Daleiden from providing the footage requested by Congress. However, Judge Orrick’s order, issued this afternoon, stated unequivocally that “Congress has the power to investigate, and it is not up to the courts to go beyond the narrow confines of determining that the committee’s inquiry is in its province.” 
Judge Orrick’s order further stated that, “Importantly in our Constitutional system, there are three equal branches of government, and courts should refrain from creating needless friction with a coordinate branch of government.” 
Congressman Jason Chaffetz, Chairman of the U.S. House Committee on Oversight and Government Reform, authorized the subpoena for the unedited footage in the wake of claims by Planned Parenthood that the videos released by David Daleiden and The Center for Medical Progress were somehow doctored, a claim vigorously denied by Daleiden. With today’s order from the District Court, the Congress will now be able to review the investigative materials and reassure the public that the videos about Planned Parenthood and the National Abortion Federation are authentic and true.

Can the ACLU and the courts order Catholic hospitals to perform abortions? Next on FOT

In Michigan the ACLU has filed a lawsuit asking the court to order Catholic hospitals to provide abortion services to women seeking them. Does the government have the legal authority to do that? Or is this just another example of how anti-Christian activists are trying to marginalize the Church?

Erin was one of the first attorneys to obtain an injunction against the Obama Administration’s HHS mandate and was named “Defender of the Faith” by the national Catholic business group Legatus. Erin’s defense of religious freedom includes her representation of 23 plaintiffs challenging the HHS Mandate, and her defense of Father Ray Leonard, the contract Naval Chaplain who was banned from celebrating Catholic Mass during a government shut-down and threatened with arrest if he volunteered to celebrate Mass or if he entered the Chapel.

Today on Faith On Trial: alternatives to Planned Parenthood; Pope’s visit

community health centers near them. The site provides a national map that displays the locations of all centers currently eligible for federal funds, with other types of centers to be added as time goes on. 
 

In addition, Lisa Bourne from LifeSiteNews.com discussed the coverage of Pope Francis’ recent trip to the United States and what’s ahead with the family synod upcoming in Rome later next month. Lisa will be in Rome covering the synod and she’ll return with her report what the synod ends.

“Thousands of low-cost health providers – offering a wide range of women’s services, like breast cancer screenings and preventative care – can be trusted with our hard-earned money,” said ADF Director of Alliance Relations Alison Howard Tuesday morning on Faith On Trial. “These federally qualified health centers offer many of the same services as Planned Parenthood and include many more services Planned Parenthood is not licensed to do: immunizations, mammograms, cardiovascular blood tests, diabetes and glaucoma screenings, radiological services, and prenatal care, for example.”

“They typically offer the full range of women’s health services without all the scandal of Planned Parenthood, which has been associated with covering up the sexual abuse of minors, committing fraud with taxpayer money, and profiting off of the sale of baby body parts,” Howard added. “It can’t be trusted, so it shouldn’t be funded.”  

GetYourCare.org is a resource made available by the pro-women and pro-life movements of America. The site explains that its goal “is to give women everywhere in America access to information about the thousands and thousands of quality health care options women have.”

“Better choices for women are usually right around the corner. Alternative women’s health options are on average less than five miles away from the nearest Planned Parenthood,” Howard explained. “According to Planned Parenthood’s own statistics, fewer than 2 percent of women ever step into a Planned Parenthood facility in a given year. There are better choices for women’s healthcare than Planned Parenthood who’s president, Cecile Richards is called before congress Tuesday morning to explain the scandals surrounding her organization. Our tax money should fund those better choices.”

Fr. Frank Pavone, national director of Priests for Life and one of the most prominent pro-live leaders in the world, will join Deacon Mike Manno and Gina Noll to discuss his new book, Abolishing Abortion; How You Can Play a Part in Ending the Greatest Evil of Our Day.

Fr. Pavone was ordained in 1988 by Cardinal John O’Connor, and since 1993 has served full-time in pro-life leadership. He is also the president of the National Pro-life Religious Council, and the national pastoral director of the Silent No More Awareness Campaign and of Rachel’s Vineyard, the world’s largest ministry of healing after abortion. He travels throughout the country, to an average of four states every week, preaching and teaching against abortion.
He was present at the bedside of Terri Schiavo as she was dying and was an outspoken advocate for her life. He was invited by members of the Class of 2009 at Notre Dame to lead an alternate commencement ceremony for those students who refused to attend the ceremony in which President Obama was honored.

Next FOT: Boston doctor fired for discussing health risks of homosexual behavior

This March a well-respected urologist, Dr. Paul Church was fired from the medical staff of Beth Isreal Deaconess Medical Center (BIDMC) in Boston because he voiced concerns to his colleagues and hospital staff about the unhealthy nature of homosexual behavior and objected to the hospital’s aggressive promotion of “gay pride” activities.

Dr. Church has been a urologist on the BIDMC staff for nearly 30 years. He is a member of the Harvard Medical School faculty and has done research on diagnosing prostate and bladder cancer, and has been a frequent volunteer for medical mission projects in Mexico and Africa. He has also spoken before educational and civic groups on the subject of high-risk sexual behaviors.

Through emails to hospital officials and later posting on the hospital’s Intranet system, Dr. Church cited irrefutable medical evidence that high-risk sexual practices common to the LGBT community lead to (among other things) a higher incidence of HIV/AIDS, STD's, hepatitis, parasitic infections, anal cancers, and psychiatric disorders.

 
Promoting such behavior, he said, is contrary to the higher mission of the healthcare facility to protect the public welfare and encourage healthy lifestyles.  Dr. Church also reminded the administration that its staff and employees represent a diversity of moral and religious views, and many believe that homosexuality is unnatural and immoral. 

The hospital did not at any time dispute the truth of his medical statements, nor did they address his other concerns.  They did not claim that Dr. Church ever discussed this with patients, or treated patients any differently if they were involved with these behaviors. You might remember a few weeks ago, the author of Making Gay Okay, Robert Reilly, raised the same questions on that week’s broadcast.  

Dr. Church’s appeal of his dismissal is now under consideration but he and his attorneys are under a court-ordered gag order to keep them from talking publically about the case. However, Dr. Church is being supported by a citizens’ organization, MassResistance, a pro-family activist organization that educates people to help them confront the attacks o n the traditional family, children, religion, and society. Sean Ryan, director of communications for MassResistance will join Deacon Mike Manno and Gina Noll this Tuesday on Faith On Trial to discuss this matter and its repercussions.

Thomas More Society files lawsuit over denial of pro-life school club

This week on FOT Jocelyn Floyd, associate counsel of the Thomas More Society will join us for a discussion of the filed a lawsuit against West Career and Technical Academy (WCTA) and Clark County School District, Las Vegas, NV on behalf of student Angelique Clark. The lawsuit claims that school administrators have violated Angelique’s free speech rights by denying her application to form a pro-life club at the school.

Angelique Clark submitted her application to start her Pro-Life Club at West Career and Technical Academy in December 2014. After months of no response from the school administration, she was finally told in February 2015 that Assistant Principal Allen Yee had denied the club. Angelique met with Mr. Yee and was given a variety of reasons why the club could not be approved, including that abortion was “controversial,” that a pro-life club would make pro-choice people feel left out, and that there were others “more qualified” to speak on the issue than a high school sophomore.

The Odegaards tell their story this week on FOT

Most folks in the Central Iowa area – as well as many around the nation – know who Betty and Richard Odgaard are; the Menonite owners of GÓ§rtz Haus Gallery in Grimes, Iowa, who declined to allow their facility to be used for a same-sex wedding ceremony.  As a result, a complaint was filed with the Iowa Civil Rights Commission and in the face of increasing legal fees they settled the case and were then forced to close their business.

This, of course, was not unprecedented. Bakers, florists, photographers across the nation have been fined and forced to close their businesses, not because they refuse to serve homosexual clients, but because they refuse to take part in a ceremony that celebrates sodomy.
This week on FOT, the Odgaards will tell their story to Deacon Mike Manno and Gina Noll: what happened to them and what they are doing now to continue to oppose the unnatural pairing of men with men and women with women.

What is happening to religious liberty in the military?

This week we’ll be discussing the challenges to religious liberty in the U. S. Military. In recent weeks and years we’ve seen at least two military chaplains – the Army’s Joe Lawhorn and Navy’s Wes Moldder – disciplined or court marshaled for the content of their religious messages.  Additionally, a young Marine lance corporal was recently court marshaled when she had a bible verse posed in her cubical and at least one national cemetery (Houston) has either banned reference to God during military funerals or required prayers be submitted in advance.

Returning to FOT to discuss these matters with Deacon Mike Manno and Gina Noll will be Michael Berry, senior counsel and director of military affairs for Liberty Institute. He joined Liberty Institute in 2013 after serving for seven years as an attorney with the U.S. Marine Corps. From 2009 until 2013, Mr. Berry served as an appellate litigator, arguing numerous cases before various federal appeals courts.  In 2008, Mr. Berry was selected for a high-profile combat deployment to Afghanistan with a Marine Corps infantry battalion. From 2009 - 2012, Mr. Berry served as an Adjunct Professor of Law at the United States Naval Academy.

Planned Parenthood is selling what???

been selling the body parts of aborted babies! Of course, this comes as no real surprise to those in the pro-life community who have seen many times the lists of parts available for purchase and the price for each, including shipping.

Great Catholic response to the Supreme Court

Dear Brothers and Sisters in Christ,
 

For a long time now, I have felt that we have entered a post-Christian era in the history of western civilization. There is almost an embarrassment about being a Christian and a denial of the roots that Christianity has provided in the development of our society. In the European society, the Euro community refused to acknowledge the historical significance of Christianity in the development of European society. The pope made an impassioned plea for that recognition, but it fell on deaf ears. Now we have a European community that is clinging to its roots, as it is slowly being destroyed by its own hubris.

Here in the United States, we are apparently a European “wannabe.” We have been slowly disavowing ourselves of any connection to religion and separating ourselves from any symbols which may be offensive, though they have been in existence for decades.

Part of it can be attributed to the tyranny of the minority -- one person is offended by a statue or a picture reflecting some religious symbolism and off we go to an activist court for social reconstruction -- the sensitivity of the one is imposed on the many.

Oh! But we have separation of Church and state, they say (actually only by judicial edict). There was no separation of Church and state when the parochial schools were educating the masses because government lacked the capacity to do so. There was no separation when the religious hospitals were providing care in areas the government could not or would not.  Nor when religious charities were providing for the homeless long before state welfare organizations were instituted.

Separation seems to be a concept of when we need you it’s “okay, please participate” and when we don’t “get out of our political way because we don’t need to be tainted by your religious zeal.”  Religion is treated like the intellectually challenged adult that, in less enlightened times, would be kept separate from the family for fear of embarrassment and from the social elite who might think less of them.

As Catholics, we have weathered the governmental and societal bashing that has taken place for 2,000 years. We survived the Roman Empire, the monarchies, the “isms,” of Nazism, communism and self-proclaimed “rationalists.” And we will survive the rejection of our own society and its continued attempt to muffle our voice and isolate us from the decision-making table. We will pay a price. But, we will not do so without preaching and teaching the truth.
    
The recent decision of the Supreme Court legalizing same sex marriage is sad, because it once again takes upon itself the redefinition of the word. This time it’s “marriage.” The definitions of words seem to not matter to the court. The simple truth is that marriage is between a man and a woman. Why? Because from the dawn of civilization men and women were joined together to perpetuate our species. Marriage constitutes a family where individuals are raised, given an identity and form the basic building block of our society.
     
In our brave new world, we can generate human beings in a test tube -- no one need know who the father is. A surrogate can be used, as would an incubator, in order to fulfill the desire for a child by two males. The terms mother and father are now subject to redefinition. Perhaps it will take a village to raise the children, especially if they will not have identifiable role models. But, we have permitted same sex individuals to claim marriage as a right at the cost of family deconstruction and role model redefinition.
     
I haven’t even broached the subject that God ordained marriage. From the beginning he created them, males and females were told to go forth and multiply. The Church has established marriage as a sacrament and it is evident in its teachings how essential the understanding of marriage between a man and a woman is to the faith.
      
I know that you have often heard the term “cafeteria” Catholic. This is a Catholic that picks and chooses what is convenient in the teachings and ignores the rest. The Supreme Court decision was made by a court composed of six Catholics, with the majority opinion rendered by Catholic judge, Justice Anthony Kennedy (supported by another Catholic, Justice Sonia Sotomayor). Perhaps, he remembered another Kennedy claiming that he would not be guided by the pope or the teachings of the Church once he is elected president. The four dissenters were Catholic with an excellent dissenting opinion rendered by Justice Antonin Scalia (concurring Chief Justice Roberts, Justice Thomas and Justice Alito).   

This was not the first time that a terrible decision was influenced or rendered by a Catholic on the Supreme Court.  Chief Justice Tawney in the Dred Scott decision actually inferred that a slave, a man, a human being, was just a piece of chattel and must be returned to the owner. This decision was the seed of Civil War and the decision of the court to define a man as property. And Justice Brennan, the only Catholic on the high court, influenced the Court in the Roe v Wade decision, voting with the majority. This decision denied any rights to the child in the womb which has led to the destruction of more than 50 million lives since 1973 (read “The Brethren: Inside the Supreme Court” by Bob Woodward and Scott Armstrong).
   
We will not be assuaged from what the Church teaches and I believe it calls for even greater courage in the face of this rejection of truth. Ever the social critic, Cardinal Francis George may be right when he said that he will die in his bed, his successor will die in jail and the one who follows his successor will die a martyr in the public square. He envisioned the social upheaval in our society as a mounting persecution of the Church. I will willingly wear the orange jumpsuit, if it means standing up for the truth and the Catholic faith.
  
I guess one doesn’t have to worry whether or not any Catholic judge or Catholic elected official would be compelled to follow the teachings of his or her faith. Unfortunately for some, it’s just a window dressing that can change with the seasons (political pressure, popular opinions and the polls). That’s a sad commentary on the effect of faith because so much truth and goodness (dignity of the human being) is found in the richness of a faith that mandates us to LOVE ONE ANOTHER.
