The family
moved to Tennessee in 2008 after a fight with German officials over their right
to home school their children. Germany
does not allow home schooling and threatened to take the children. The family had been granted asylum by a
federal immigration judge in Tennessee, but that grant was overturned by the
appeals court in May.
The family is
being represented by the Home School Legal Defense Association. Attorney and chairman of the association,
Michael Farris said he believes the appeals court was wrong when it did not
find that the German school law did not discriminate against religious minorities.
